1. Introduction and Definitions

Welcome to the website of Ben Yehuda 98 TLV Ltd., operators of Scarlet Hotel ("the Website", "the Hotel", "we"). These Terms of Service ("Terms") define the conditions for using the website and the booking and services provided through it. Use of the website constitutes full agreement to these Terms. If you do not agree to these terms, please refrain from using the website.

Definitions:

  • "Website" - The Scarlet Hotel website at www.scarlet-hotel.com
  • "Hotel" - Ben Yehuda 98 TLV Ltd., Company No. 515533065
  • "User" - Any person browsing the website or making a reservation
  • "Reservation" - Booking of accommodation services at the hotel
  • "Consumer" - As defined in the Israeli Consumer Protection Law, 5741-1981

2. Making Reservations

2.1 Reservation Process

A reservation is considered confirmed only after receiving written confirmation (email or SMS) from the hotel. The hotel reserves the right to refuse or cancel a reservation in exceptional cases.

2.2 Minimum Age

The minimum age for making a reservation and checking into the hotel is 18 years. Valid ID must be presented at check-in.

2.3 Payment and Pricing

Payment shall be made by valid credit card. In certain cases, the hotel may require a deposit or full prepayment.

💰 VAT and Pricing

For Israeli Residents: All prices displayed on the website include VAT (18%). The final price shown is the price to be paid.

For Tourists: Tourists are exempt from VAT upon presentation of a valid entry visa (B2/B3/B4) and foreign passport at check-in. If appropriate visa is not presented, the guest will be charged VAT as required by law.

⚠️ Typographical Error Clause

The hotel reserves the right to cancel a reservation in case of an obvious and exceptional pricing error (typographical error), subject to notifying the guest as soon as possible and no later than 24 hours from the time of booking. In such case, any amount paid will be refunded in full.

3. Cancellation and Refund Policy

⚖️ Important Notice - Consumer Rights under Israeli Consumer Protection Law

3.1 Legal Right of Cancellation (Distance Transaction)

Under the Israeli Consumer Protection Law, 5741-1981, consumers have the right to cancel a distance transaction (online):

  • Within 14 days from booking - Cancellation without need for explanation
  • Up to 7 days before accommodation date - Subject to maximum cancellation fees
  • Cancellation fees: Up to 5% of transaction value or NIS 100, whichever is lower

3.2 Hotel Cancellation Policy

  • Cancellation up to 48 hours before: No charge (except legal cancellation fees)
  • Cancellation less than 48 hours before: First night charged
  • No-Show: Full reservation charged

3.3 Special Periods

During holidays, weekends, and peak periods, special cancellation policies may apply as indicated at the time of booking.

4. Check-in and Check-out

  • Check-in: From 3:00 PM
  • Check-out: Until 11:00 AM
  • Early/Late check-in or check-out: Subject to availability and prior arrangement, may incur additional charges

5. House Rules

🚫 Important Restrictions

  • No parking available at the hotel. Public parking is available at Gordon Parking (Gordon Street corner HaYarkon), 2-minute walk.
  • No pets allowed - except certified service dogs.

Additional Rules:

  • Smoking: Smoking is prohibited in all hotel areas. Fine for smoking in room: NIS 500
  • Quiet Hours: 11:00 PM to 8:00 AM
  • Visitors: External visitors are not permitted in rooms without prior approval
  • Maximum Occupancy: As defined for the room at time of booking
  • Damages: Guest is responsible for any damage caused to hotel property

6. Liability

  • The hotel is not responsible for valuables not deposited in the room safe or at reception
  • The hotel is not responsible for indirect or consequential damages
  • Hotel liability is limited to the amount actually paid for the reservation
  • The hotel reserves the right to relocate a guest to an equivalent or superior alternative room

7. Intellectual Property

All content on the website, including text, images, logos, design, and software, is the exclusive property of Ben Yehuda 98 TLV Ltd. No copying, reproduction, distribution, or commercial use of content is permitted without prior written approval.

8. Privacy

Collection and use of personal information is conducted in accordance with the hotel's Privacy Policy, available at: Privacy Policy

9. Governing Law and Jurisdiction

These Terms shall be governed exclusively by the laws of the State of Israel.

The exclusive jurisdiction for any matter related to these Terms, including any dispute or disagreement arising from or connected to them, shall be the competent courts in the city of Tel Aviv-Jaffa only.
